Larry Lightfoot, PC

The team received a sponsorship (actually the initial one) from Larry P. Lightfoot, PC in the amount of $250. I expect to contribute more in the future.

I'm an estate planning, estate administration, and business planning attorney.   Before, and while attending law school, I practiced as a CPA.   As an attorney, I am board certified in estate planning and probate law. To become board certified you must be recommended by 10 attorneys or judges, practice the required percentage of your total practice in that discipline, annually take a certain number of education hours in that subject, and pass a day long exam. Less than 1% of the attorneys licensed in Texas are board certified in estate planning and probate law.

My practice is approximately 90% estate planning and administration and the rest is corporate law.   I handle everything from the simplest estate plans and administrations to the very complex. In a nutshell, you need a Will. If you don't write one, the State of Texas will write one for you, and you may not like what it says, particularly if you have a blended family.   For families with young children, the most biggest part of the plan is often what happens if both parents pass away while their children are still kids. The estate plan should answer the question of who will raise the children and at what age should the children receive their inheritance.

As important as it is to have a Will (or a revocable trust if it fits the situation), it is equally important to have property correctly titled and beneficiary designations for life insurance, retirement plans, and annuities coordinated with your documents in order for you plan to be effective. For example, if life insurance is a big part of your estate, and your Will says hold my children's' inheritance in trust until age 30, but your beneficiary designation is (i) spouse as the primary beneficiary and (ii) child A and child B as the contingent beneficiaries, your Will did you no good. The children get the proceeds at 18 or 21 years of age and a guardianship will probably be set up while they are minors, and a good amount of the insurance will be used for court filings, legal fees, etc.   

If your property, including retirement plans, annuities and life insurance equals the amount of the unified credit (currently $2,000,000) you should construct a plan to minimize federal estate taxes. If you don't, the federal government may be one of the largest beneficiaries of your estate.

Finally, you should plan for incapacity and if there is someone you have confidence in, name then as your agent to handle proper transactions and make medical decisions if you can't make them your self. If you don't want to be kept alive artificially a physician's directive (a/k/a Living Will) can be used to tell your family and doctor your wishes for a time that you couldn't tell them yourself.
